By accessing our website, reserving, and/or participating on a tour with Overland Photo Collective LLC (“Company,” “we,” “us,” or “our”), you (“Client,” “Participant,” or “you”) agree to the following Terms & Conditions.
1. Booking & Payment
A non-refundable deposit of 30% per person is required to secure your reservation.
The remaining balance is due no later than 60 days prior to the tour start date.
If full payment is not received by the due date, the Company reserves the right to cancel your booking without refund of deposit.
Bookings made within 30 days of departure require full payment at the time of booking.
2. Cancellations & Refund Policy
All cancellations must be submitted in writing via email to explore@overlandphotocollective.com
Deposits are non-refundable unless otherwise stated in writing.
Cancellation fees:
60+ days before departure: Refund minus deposit
30–59 days before departure: 50% refund of total tour price
0–29 days before departure: No refund
No refunds will be issued for unused portions of the tour, including missed days, early departure, or failure to participate.
We strongly recommend purchasing travel insurance that covers cancellation, medical, and emergency evacuation.
3. Weather & Conditions
Photography tours operate in natural outdoor environments. Weather, lighting, road conditions, and park access are beyond our control.
No refunds will be issued due to weather conditions, natural events, or environmental factors.
We reserve the right to modify locations or schedules for safety, lighting conditions, or operational reasons.
4. Assumption of Risk
Participants acknowledge that photography tours may involve:
Hiking on uneven terrain
Exposure to extreme temperatures
Wildlife encounters
Remote locations
Vehicle travel on paved and unpaved roads
By booking, you voluntarily assume all risks associated with participation.
5. Release of Liability
To the fullest extent permitted by law, you agree to release and hold harmless Overland Photo Collective LLC, its owners, employees, contractors, guides, and affiliates from any liability for:
Personal injury
Illness
Property damage
Equipment loss
Delays or travel disruptions
This includes incidents caused by negligence, except in cases of gross negligence or willful misconduct.
6. Medical & Physical Requirements
Participants are responsible for ensuring they are physically capable of participating.
You agree to disclose any relevant medical conditions prior to departure.
The Company reserves the right to remove a participant from a tour if their participation poses a safety risk.
7. Travel & Transportation
Participants are responsible for arranging their own transportation to the designated meeting location unless otherwise stated.
The Company is not responsible for airline delays, missed connections, or travel disruptions.
Seatbelt use is required in Company vehicles at all times.
Participants are responsible for all required travel visas and documentation necessary to enter and exit the country and area of the trip.
8. Conduct
We maintain a professional, respectful learning environment.
Overland Photo Collective LLC reserves the right to remove any participant without refund for:
Unsafe behavior
Harassment or inappropriate conduct
Illegal activity
Disruption of the group experience
9. Photography & Media Release
By participating, you grant the Company permission to use photographs or video taken during the tour that may include your likeness for marketing and promotional purposes.
If you prefer not to appear in marketing materials, you must notify us in writing prior to the tour.
10. Intellectual Property
All instructional materials, itineraries, and tour content remain the intellectual property of Overland Photo Collective LLC. They may not be reproduced, distributed, or used commercially without written consent.
11. Minimum Participants & Cancellation by Company
Tours require a minimum number of participants.
If the minimum is not met, we reserve the right to cancel the tour. In such cases, participants will receive a full refund of payments made to the Company.
The Company is not responsible for non-refundable travel costs incurred by participants.
12. Force Majeure
Overland Photo Collective LLC is not liable for failure to perform due to events beyond its reasonable control, including but not limited to:
Natural disasters
Government restrictions
Public health emergencies
Park closures
Civil unrest
In such cases, refunds or credits will be issued at the Company’s discretion.
13. Equipment Responsibility
Participants are fully responsible for their own photography equipment and personal belongings.
Overland Photo Collective LLC is not liable for loss, theft, or damage.
14. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Arizona, United States.
Any disputes shall be resolved in the courts located in Coconino County, Arizona, United States.
15. Agreement
By booking a tour, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
